Terms of Use

These Terms of Use (the "Terms") govern access to the website cygon.tech and the use of the Cygon software (together, the "Services"), published by INSPYRSTUDIO. They apply to any user, whether Cygon is used free of charge or under a paid subscription, and whether the user is a consumer or a professional.
The financial conditions applicable to paid subscriptions (plans, prices, payment, term, cancellation, right of withdrawal, warranties) are set out in the Terms of Sale, which supplement these Terms. In the event of a conflict on a strictly financial matter, the Terms of Sale prevail.
1. Definitions
- INSPYRSTUDIO, "we", "our": the company that publishes the Services, identified in Article 2.
- Cygon: the software for editing and generating dynamic 3D environments published by INSPYRSTUDIO, together with its components and associated services (including the Cygon Link feature).
- Site: the website accessible at cygon.tech and its subdomains.
- Services: the Site and the Cygon software, taken together.
- User, "you", "your": any natural or legal person who accesses or uses the Services.
- Consumer: any natural person acting for purposes that are outside their professional activity.
- Professional: any natural or legal person acting for purposes relating to their professional activity.
- Account: the personal space created by the User to access Cygon.
- User Content: all data, files, projects, models, scenes, 3D environments and works that the User creates, imports, edits or exports using Cygon.
- Free plan: the Starter and Student plans, made available at no charge.
- Paid plan or Subscription: the Accessibility, Standard and Believer plans, giving access to Cygon's reserved features, under the conditions of the Terms of Sale.
- Force majeure: an event within the meaning of Article 1218 of the French Civil Code and French case law.
2. Publisher of the Services
The Services are published by:
INSPYRSTUDIO, a simplified joint-stock company (société par actions simplifiée, SAS) with a share capital of €80,000, registered with the Chambéry Trade and Companies Register under number 101 208 809 (RCS Chambéry), whose registered office is at Savoie Technolac, 19 boulevard Mer Caspienne, 73370 Le Bourget-du-Lac, France.

3. Acceptance and proof
Access to and use of the Services require full and unreserved acceptance of these Terms. By creating an Account, downloading Cygon or using the Services, you acknowledge that you have read, understood and accepted the Terms. When the Account is created or a subscription is taken out, this acceptance is obtained expressly (dedicated checkbox). If you do not accept the Terms, you must not use the Services.
INSPYRSTUDIO keeps, in an electronic form designed to ensure its integrity, a record of your acceptance; this record is proof between the parties, save evidence to the contrary.
If you use the Services on behalf of a legal entity (studio, company, association), you represent that you have authority to bind it and accept the Terms in its name and on its behalf.
4. Capacity and minimum age
The Services are reserved for persons who are legally capable of entering into contracts under applicable law.
Use of the Services is reserved for persons aged at least 15. A minor User (under 18) may create an Account, and a fortiori take out a paid Subscription, only with the prior authorisation of their legal representative, who is deemed to accept these Terms and, where applicable, the Terms of Sale. INSPYRSTUDIO may at any time request proof of age or of parental authorisation.
5. Description of the Services
Cygon is software for designing, prototyping and generating dynamic 3D environments, based on proprietary technology for encoding 3D environments.
Cygon is offered under a "freemium" model:
- a free "Starter" plan gives access to the layout engine and allows environments to be created, without export;
- a free "Student" plan, subject to providing valid proof of student status, gives full access to Cygon;
- paid plans ("Accessibility", "Standard" and "Believer") give access to all of Cygon's features, including unlimited export of environments and the Cygon Link integration. These three paid plans unlock exactly the same features and differ only in price (see the Terms of Sale).
The dividing line between free and paid use is export: everything you build belongs to you and remains accessible, but exporting an environment requires a plan that allows export (an active paid Subscription or the Student plan).
"Beta" status. Cygon is provided in a beta version: the software is under active development and new features (advanced textures, more complete environments, modular buildings, etc.) are added progressively. Certain announced features may not yet be available. Cygon's characteristics, interface and functional scope are subject to change.
6. User account
Access to Cygon requires the creation of an Account. The User undertakes to provide accurate, complete and up-to-date information, and to keep it updated in the event of change.
Login credentials (e-mail address and password) are personal and confidential. The User is responsible for keeping them safe and for any activity carried out from their Account. In the event of unauthorised use of their Account or of a security breach, the User must change their credentials and inform INSPYRSTUDIO without delay at contact@cygon.tech.
An Account is individual. Except under a plan expressly provided for that purpose, sharing an Account or its credentials between several persons is prohibited.
7. Licence to use Cygon
Subject to compliance with these Terms and, for paid features, with the Terms of Sale, INSPYRSTUDIO grants the User a personal, non-exclusive, non-transferable and non-sublicensable right to use Cygon, for the duration of use of the Services and for their own needs (including professional needs), in accordance with the software's intended purpose.
This licence does not entail any transfer of ownership of Cygon. In particular, unless mandatorily authorised by law or with the prior written consent of INSPYRSTUDIO, it is prohibited to:
- copy, reproduce, distribute, communicate to a third party or make available to third parties all or part of Cygon;
- modify, adapt, translate or create derivative works of Cygon;
- decompile, disassemble or reverse-engineer, beyond what is mandatorily permitted by law; as regards interoperability, the User shall first consult INSPYRSTUDIO to verify that the necessary information is not readily accessible;
- circumvent or attempt to circumvent technical protection, security or rights-management measures, in particular the export limitation;
- rent, lend, resell or commercialise access to Cygon.
INSPYRSTUDIO reserves the right to correct errors in Cygon of which it is the publisher.
8. Intellectual property and use of your data
8.1 INSPYRSTUDIO's rights
Cygon, the Site, the name "Cygon", the logos, trademarks, interface, documentation, databases, source and object code, algorithms and underlying technology are and remain the exclusive property of INSPYRSTUDIO or its licensors, and are protected by intellectual property law. INSPYRSTUDIO holds or lawfully exploits all the rights necessary to provide the Services. No right other than the licence to use provided for in Article 7 is granted to the User.
8.2 Your creations
You remain the sole and exclusive owner of the User Content you create using Cygon, whatever the plan. You may use and export your creations freely, including for commercial purposes and in commercial projects or games, with no royalties or fees payable to INSPYRSTUDIO. INSPYRSTUDIO claims no ownership right over your User Content.
You are responsible for your User Content and warrant that you hold all the rights necessary over the elements you import or integrate into Cygon. INSPYRSTUDIO exercises no control over the creations produced using Cygon and does not warrant that they are free from infringement of third-party rights; it is your responsibility to ensure this.
8.3 Use of your data depending on the plan
To provide, secure and improve Cygon, INSPYRSTUDIO processes certain data under the conditions below. Details of the processing operations, legal bases and retention periods are set out in the Privacy Policy.
Paid plans (Accessibility, Standard, Believer). INSPYRSTUDIO does not reuse any of your creations. Only the technical and usage data (logs, diagnostic and telemetry data) strictly necessary to provide, secure, debug and improve Cygon is processed. Your environments and creations are neither exploited nor used to train our models.
Free plans (Starter, Student). In consideration of Cygon being made available free of charge, and for as long as you use a free plan, you grant INSPYRSTUDIO a non-exclusive, worldwide and royalty-free licence to use (i) the data you enter or create and your creations (User Content), and (ii) the technical and usage data collected, solely for the purpose of improving Cygon, including through automated processing such as the training of artificial intelligence models. You retain full ownership of your creations and all your rights to use and commercially exploit them: this licence entails no transfer of ownership. No remuneration is due for this licence, its consideration being the free availability of the plan.
This reuse is framed: our models are configured so as not to reproduce, for the benefit of another user, a creation whose form is identical or similar to yours. The difference between free and paid plans regarding the reuse of your creations is clearly reminded to you when you choose your plan.
8.4 Technical rights necessary for the service
In all cases, you grant INSPYRSTUDIO the technical rights strictly necessary to host, store, process and display your User Content for the sole purpose of providing the Services (for example, storing and returning your projects to you). These rights end upon deletion of the User Content or of your Account, subject to technical and legal retention periods.
9. Obligations and prohibited uses
The User undertakes to use the Services fairly, in accordance with the Terms, public order and applicable laws. In particular, it is prohibited to:
- use the Services for unlawful or fraudulent purposes or in a way that infringes the rights of third parties;
- import, store or distribute through the Services any unlawful, infringing, defamatory, hateful, violent content, content that harms privacy or dignity, or that is manifestly inappropriate;
- undermine the security, integrity or availability of the Services (intrusion, injection, overload, distribution of malicious code, etc.);
- access the Services by unauthorised automated means (bots, mass scraping) in a way that disrupts their operation;
- circumvent technical limitations, in particular those distinguishing free from paid use;
- impersonate a third party or provide false information, in particular to unduly benefit from a plan (for example the Student plan) or a discount.
The User is responsible for any use of the Services made from their Account, including by persons they authorise to use it.
10. Reporting unlawful content
In accordance with French Act No. 2004-575 of 21 June 2004 on confidence in the digital economy, INSPYRSTUDIO provides a means of reporting manifestly unlawful content, at contact@cygon.tech. Where there are serious grounds to fear it, INSPYRSTUDIO may suspend, as a precaution, access to content or to an Account, and shall inform the User, except where the law or the interests of an investigation preclude it.
11. Personal data
The processing of Users' personal data is described in the Privacy Policy and the Cookie Policy, accessible from the Site. These policies specify, among other things, the data collected, the purposes, the legal bases, the retention periods, the recipients and the rights available to you under Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. 12. Availability, maintenance and evolution of the Services
INSPYRSTUDIO endeavours to make the Services available 24/7, without any obligation to achieve a specific result. Access may be suspended or limited, in particular for maintenance, update or security operations, in the event of Force majeure, or due to third-party providers (hosting, network, payment).
The User is informed that electronic communications networks offer only relative technical reliability (uneven capacity, congestion, worldwide routing) and acknowledges that such contingencies may not be attributed to INSPYRSTUDIO.
As Cygon is under constant development, INSPYRSTUDIO may change, add, modify or remove features. Where an evolution has significant consequences on use, the User is informed by an appropriate means within a reasonable time. Updates, including security updates, necessary to maintain the conformity of the Services are provided under the conditions laid down by law and detailed, for Subscriptions, in the Terms of Sale.
13. Retention and fate of your creations
While you use the Services, your creations are stored on our servers. In the event of cancellation, deletion of the Account or termination of access to the Services, INSPYRSTUDIO keeps your creations for fourteen (14) days to allow you to retrieve them, then deletes them. Creations that you delete yourself are kept for seven (7) days (recovery net) before permanent deletion. On request made within these periods, INSPYRSTUDIO returns your data to you in a standard machine-readable digital format.
It is your responsibility to export and back up your creations in good time, in particular before your access ends. After these periods, INSPYRSTUDIO is under no further retention obligation.
14. Liability
INSPYRSTUDIO provides the Services with the reasonable care expected of a diligent professional. Given the beta status of the Services and their evolving nature, the Services are provided "as is" and "as available", with no warranty other than those mandatorily provided by law (see, for consumers, the legal guarantee of conformity recalled in the Terms of Sale).
INSPYRSTUDIO may not be held liable for:
- damage resulting from use of the Services that does not comply with the Terms;
- loss of User Content attributable to the User (failure to back up on their side, mishandling, deletion); it is the User's responsibility to keep their own backup copies of their exported creations;
- malfunctions related to the User's hardware, third-party software, network or internet connection;
- infringements of third-party rights resulting from the User Content;
- indirect damage, such as loss of business, revenue, customers, commercial data or reputation.
Provisions specific to consumers. No provision of these Terms has the effect of limiting or excluding INSPYRSTUDIO's liability where the law prohibits it. The above limitations do not apply to personal injury, gross or wilful misconduct, or the rights that the consumer holds mandatorily under the French Consumer Code and the French Civil Code.
Provisions specific to professionals. Towards professional Users, and to the extent permitted by law, INSPYRSTUDIO's total liability, all damage combined, in respect of the use of the Services, is limited to the sums actually paid by the User over the twelve (12) months preceding the triggering event, or to €100 for free use. INSPYRSTUDIO is liable only for direct and foreseeable damage. The professional shall indemnify INSPYRSTUDIO against any third-party claim resulting from their use of the Services or their User Content.
15. Force majeure
Neither party may be held liable for a failure to perform its obligations resulting from a case of Force majeure within the meaning of Article 1218 of the French Civil Code (in particular natural disaster, fire, general failure of electronic communications or electricity networks, failure of a hosting provider, large-scale cyberattack, decision of the authorities). The affected party shall inform the other without delay; performance of the affected obligations is suspended for the duration of the impediment. If the Force majeure lasts more than sixty (60) days, either party may terminate as of right, without compensation.
16. Suspension and termination
By the User. The User may stop using the Services and delete their Account at any time. Cancellation of a paid Subscription is governed by the Terms of Sale.
By INSPYRSTUDIO. In the event of a breach by the User of the Terms (in particular Articles 7 and 9), INSPYRSTUDIO shall send a reasoned notice inviting the User to remedy the breach within thirty (30) days, except in the event of a serious or repeated breach or a security risk, in which case suspension or termination may be immediate. On expiry of the period without remedy, INSPYRSTUDIO may suspend, restrict or terminate access to the Account.
Where the User holds a paid Subscription, termination for their fault does not give rise to a refund of periods already paid, without prejudice to the mandatory rights of the consumer.
Deletion of the Account entails deletion of the associated User Content, subject to the retention periods provided for in Article 13 and in the Privacy Policy.
17. Commercial reference
INSPYRSTUDIO may mention the professional User (name and, where applicable, logo) as a commercial reference on its communication materials. The professional User may object at any time at contact@cygon.tech. As regards consumers, no such mention is made without their prior consent.
18. Amendments to the Terms
INSPYRSTUDIO may amend these Terms in order to adapt them to legal, regulatory, technical or commercial developments in the Services. The applicable version is the one in force at the date of use of the Services. In the event of a substantial change, Users with an Account are informed by an appropriate means (e-mail or notification) within a reasonable time before it takes effect. Continued use of the Services constitutes acceptance of the amended Terms; failing acceptance, the User may stop using the Services and close their Account.
19. Severability — No waiver
If any provision of these Terms is held to be void or unenforceable, the other provisions shall retain full effect. INSPYRSTUDIO's failure to rely on a breach does not constitute a waiver of the right to rely on it subsequently.
20. Governing law and disputes
These Terms are governed by French law.
In the event of a dispute, the User is invited to contact INSPYRSTUDIO beforehand at contact@cygon.tech in order to seek an amicable solution. The procedures for complaints and dispute resolution are detailed in the Terms of Sale.
Failing an amicable settlement, and subject to the mandatory rules of jurisdiction protecting consumers (who may bring proceedings before the court of their place of domicile), the French courts shall have jurisdiction; towards professionals, jurisdiction is conferred on the courts within the jurisdiction of INSPYRSTUDIO's registered office.
